Privacy

BrainCube Aeromodels by necessity must store personal details of its customers. These details are used purely for the purposes of fulfilling your order, and sending occasional product announcements via an email newsletter, if you have chosen to receive them. Your personal details will never be transferred, transmitted or made available to a third party unless obliged to by law.

BrainCube Aeromodels uses PayPal for processing of electronic payments. We do not have access to any of your financial details, such as credit card number or bank account number, and responsibility for the protection of these details rests with PayPal.

Terms and Conditions of Sale

Pricing and payment

Unless otherwise stated, all prices are in pounds sterling (UKP), include UK VAT and exclude delivery charges (and any import or customs duties if outside the EU). The delivery charges will be clearly displayed during the checkout process. The buyer is responsible for handling any import or customs duties specific to your country.

We accept payment from most major credit/debit cards via PayPal. A PayPal account is NOT required. Payment may be made directly from your PayPal account if you have one. We also accept payment by cheque or money order sent to us by post, for UK orders only.

Your order will not be processed until we have received payment and it has successfully cleared into our bank or PayPal account, whichever occurs sooner. Prices, offers and products are subject to availability and may change at any time prior to acceptance of your order.

Whilst we will endeavour to ensure the prices on the web site are as accurate as possible, we reserve the right to change a price in exceptional circumstances. If a price is corrected due to exceptional circumstances, you will be informed of the change before payment is processed and offered the opportunity to cancel the order.

If an order is placed for an item with an erroneous price, and the erroneous price is less than the cost price of the item, we reserve the right to cancel the order.

Delivery

Your order will be delivered via the shipping method you chose during the checkout process. Delivery charges are non-refundable. It is your responsibility to ensure that you comply with any import or customs regulations that apply in your country to goods shipped from the UK. It is also your responsibility to ensure that the delivery address is correct.

Once your order has been dispatched, it is no longer the responsibility of BrainCube Aeromodels.

Your right to cancel

In accordance with UK law, 'The Consumer Protection (Distance Selling) Regulations 2000', you have the right to cancel an order within a "cooling off" period of 7 working days after receiving it. You may return the goods to us for a refund of the purchase price of the item, subject to the following conditions:

• You provide us with written notice, within 7 days of receiving your order, that you wish to cancel that order.
• The goods are unused and in re-stockable condition, with all the original packaging, parts, accessories, manuals, etc.
• The goods are not bespoke, built to your specifications (if they are, they can NOT be returned unless faulty).
• Any delivery charges you paid to us are non-refundable.
• You are responsible for ensuring the safe return of goods and for any delivery costs you incur when returning the goods to us.
• Any free gifts provided with the product must also be returned.

If would like to return goods under this legislation, and your return meets all of the above requirements, please provide us with written notice of your intent to cancel your order. We will then provide you with the appropriate returns instructions. You can do this by either notifying us by letter or e-mail, see the Contact page.

Returns, Exchanges and Warranty

If your goods are damaged in transit and arrive physically damaged, then you should report the damage to us within 7 days of delivery. Replacement goods will be dispatched as soon as possible after the damaged goods have been returned.

If the goods received are different from those ordered, then you should report the difference to us within 7 days of delivery. Replacement goods will be dispatched as soon as possible after the incorrectly sent goods have been returned.

Products we have manufactured have a one-year warranty for domestic and general business use. The warranty does not cover any form of misuse, customer inflicted damage, accidental damage, wear and tear or commercial use. Please note that if repairs are done other than by our authorised agents or ourselves any warranty will be void. If the quality control seal on a returned product has been broken, removed or tampered with in any way, then the warranty will be void. Faulty goods will be repaired or replaced as we deem appropriate. If the goods are no longer available and cannot be repaired, we will offer a refund or alternative product.

All returns must receive prior authorisation from BrainCube Aeromodels. You must contact us before returning goods to receive returns instructions. Your failure to follow and comply with the information in our returns policy will result in your return being rejected.

Your return will also be rejected if the returned goods are found not to be damaged or faulty, or are found to have suffered damaged as a result of customer misuse.

If your return has been rejected then you will be liable for a 25% administration fee and the return delivery costs incurred when your goods are returned to you, or you may at our discretion be entitled to a refund minus a 25% administration fee.

Product exchanges, where the goods received are not faulty, are permitted solely at our discretion. If permitted, you will be liable to pay the difference in price if the required item is of a higher value, and your exchanges will also be subject to our standard delivery charges. Requests for a product exchange must be made by E-mail or in writing within 7 days of delivery of your order.

Claims and Liabilities

Whilst every care is taken during product development and production, we have no control over how our products are used. We also are unable to test every possible situation that our products may be used in. As such, we will not be held responsible for any damage caused through the use of goods supplied by us. Use of goods purchased from us is entirely at your own risk.

Our products must not be used in any mission critical application, or application in which human life may be at risk. This includes, but is not limited to, manned vehicles of any sort or use in a hazardous environment.

We shall not be liable to you for any failure or delay in performance of the contract, if it is due to an event beyond our reasonable control. Including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed, we shall be entitled to a reasonable extension of time in meeting contractual obligations.

You will be responsible for the goods once they have been delivered. Our responsibility for everything other than damage due to our negligence will end at the time the carrier delivered the goods to you.

We will not be liable for any losses, costs, damages, charges or expenses that are incurred by you as a result of a delay in delivery or as a result of our inability to supply the ordered goods.

You agree to indemnify us against any claims, losses, liabilities, damages and expenses (including legal fees), arising out of your use of this site.

General

We reserve the right to decline any order for any reason.

We reserve the right to cancel your contract with us at any time if your behaviour is found to be inappropriate, inconsiderate or unreasonable. Sales on this site are governed by Scottish law and you agree to submit any dispute to the exclusive jurisdiction of the Scottish courts. All orders are subject to these terms and conditions, and no amendments will be accepted by us.

These terms and conditions do not affect your legal rights.

We reserve the right to update these terms and conditions as and when we deem necessary.
